Current Status of Vietnamese Law on Procedures and Processes for Mediation of Individual Labor Disputes by Labor Mediators

In today's increasingly dynamic and integrated Vietnamese labor market, conflicts of interest between workers and employers are inevitable and have shown signs of increasing in number. To address these disputes, Vietnamese law has established a strict procedure and process. The initial stage of resolving labor disputes is the mediation process conducted by labor mediators, who act as a bridge to help the disputing parties find common ground and reach an agreement. The frequency of labor disputes, especially between individual workers and employers, has increased significantly in recent years. The Covid-19 pandemic has exacerbated this issue. This article analyzes the limitations of the current legal framework governing mediation in labor disputes and draws on international best practices to propose recommendations for improvement. The goal is to enhance the legal framework for resolving labor disputes and meet the evolving needs of the labor market.
